The regulations also stipulate that the quality and safety of industrial products can be effectively guaranteed through consumer self-judgment, corporate self-discipline and market competition, and no production license system is implemented. The quality and safety of industrial products can be effectively guaranteed through the certification and accreditation system, and no production license system is implemented. The competent department of industrial product production license of the State Council, in conjunction with the relevant departments of the State Council, evaluates, adjusts and gradually reduces the catalogue in due course, and announces it to the public after approval by the State Council.
Any enterprise that does not obtain a production license may not produce products listed in the catalog. No unit or individual may sell or use a cataloged product that does not have a production license in its business activities.
In addition, the regulations also clarify that the competent department of production licenses for industrial products of the State Council is responsible for the unified management of production licenses for industrial products in accordance with these Regulations. The competent department for the production of local industrial products at or above the county level is responsible for the production licenses for industrial products within its administrative region. For the term of the production license, the regulations stipulate that the production license is valid for 5 years, but the production license of the food processing enterprise is valid for 3 years. If the production license expires and the enterprise continues to produce, it shall submit an application for renewal of the license to the competent department of industrial product production license of the local autonomous region or municipality directly under the Central Government six months before the expiration of the production license.
